1: Agreement Overview

1.1 These Terms and Conditions ("Agreement") govern the services provided by Broke N’ Busy Productions ("BNBP") to artists, bands, or clients ("Artist") for live production, sound, lighting, or venue hire services within Queensland, Australia.

1.2 By engaging BNBP’s services, the Artist acknowledges and agrees to be bound by these terms. This constitutes a legally binding agreement.

1.3 BNBP reserves the right to refuse or cease services if these terms are breached, or if unsafe conduct occurs. BNBP's decision is final.

2: Bookings & Deposits

2.1 A deposit of 25% of the total agreed fee is required to secure a booking.

2.2 A booking is confirmed when BNBP has received the deposit and issued written confirmation (email is acceptable) of the event date, time, and location.

2.3 The remaining balance must be paid in full by the date specified in the written confirmation. BNBP reserves the right to charge interest on overdue amounts in accordance with the Late Payment Legislation Act 2002 (Qld).

2.4 Late Payment Fee; A late payment fee of 10% of the outstanding amount will be applied to invoices more than 7 days overdue.

2.5 Cancellation Policy; Cancellations made more than 48 hours prior to the event will result in a refund of the deposit.
Cancellations made within 48 hours of the event will result in forfeiture of the deposit.
In the event the event is cancelled due to circumstances beyond the reasonable control of either party (e.g., natural disaster, venue closure, government-imposed restrictions), both parties will be excused from performance. BNBP will endeavour to provide a rescheduled date where possible.

3: Equipment Use & Handling

3.1 Artists are not permitted to touch or move any of the following without prior, written consent from BNBP:

Front of House (FOH) speakers, subwoofers, and loudspeakers.
Foldback monitors.
PA cabling and signal lines between mixer, FOH, and foldbacks.
Lighting trees, PAR cans, DMX cables, and control desks.
Mixers or digital consoles used for FOH or lighting.

3.2 Artists may use BNBP’s backline equipment (e.g., amplifiers, drum kits) where provided. Artists are responsible for any damage caused to backline equipment due to misuse or negligence.

3.3 Consumption of beverages is permitted on stage, provided they are in closed, capped bottles (e.g., water bottles). Open containers are strictly prohibited on or near BNBP equipment.

3.4 Any misuse, damage, or unauthorized modification of BNBP equipment may result in immediate termination of services and potential invoice for repairs or replacement at BNBP’s discretion.

4: Responsibility For Equipment & Insurance

4.1 The Artist is responsible for loss, theft, or damage to BNBP equipment while it is under their care, custody, or control.

4.2 BNBP will invoice the Artist for the cost of repairs or replacement (at current market rates) for any damaged, lost, or misused equipment.

4.3 Artists using BNBP equipment at public events or venues must hold current and valid Public Liability Insurance (PLI) with a minimum coverage of $2,000,000. Proof of insurance must be provided to BNBP prior to setup.

4.4 The Artist is solely responsible for their own equipment (instruments, amplifiers, pedals, cables, etc.). BNBP accepts no liability for loss or damage to Artist-owned gear.

5: Sound, Volume & Noise Restrictions

5.1 All sound levels must comply with applicable venue, local council, or event regulations.

5.2 If the Artist wishes to exceed approved noise levels, they must obtain a Sound Restriction License at their own expense and provide proof to BNBP prior to the event.

5.3 Any fines, penalties, or fees resulting from excessive noise or non-compliance will be the sole responsibility of the Artist.

5.4 BNBP reserves the right to reduce volume levels to comply with regulations or address noise complaints.

6: Safety & Conduct

6.1 All Artists, crew, and staff must adhere to safety instructions issued by BNBP or venue management.

6.2 Appropriate footwear (closed-toe shoes) is required on stage and during setup or packdown.

6.3 Artists must use safe lifting techniques when handling equipment to prevent injury.

6.4 Individuals under the influence of alcohol or drugs are prohibited from handling or operating equipment.

6.5 Smoking or vaping near any production equipment is strictly prohibited.

6.6 BNBP reserves the right to halt a performance or refuse service if unsafe or inappropriate behaviour occurs.

7: Venue & Site Conditions

7.1 The Artist must ensure the venue or performance space provides adequate and safe access, shelter, and a suitable power supply for all BNBP equipment. BNBP is not responsible for inadequate power supply or other venue deficiencies that impact the performance.

7.2 BNBP is not liable for delays or cancellations caused by inadequate venue conditions or unsafe environments.

7.3 For outdoor events, appropriate weather protection for equipment and staff is required. BNBP reserves the right to postpone or cancel the event for safety reasons.

8: Liability & Indemnity

8.1 To the fullest extent permitted by law, BNBP is not responsible for any injury, loss, or damage incurred by the Artist or their property during setup, performance, or packdown.

8.2 The Artist agrees to indemnify and hold harmless BNBP, its staff, and contractors against any claims, damages, or losses resulting from the Artist's actions or negligence.

8.3 BNBP maintains Public Liability Insurance; however, this insurance does not cover Artist-owned property or liability caused by the Artist.

9: Disputes & Mediation

9.1 In the event of a dispute, both parties agree to attempt to resolve the matter through mediation with a neutral third party before pursuing legal action.

9.2 All legal matters will be governed by and construed in accordance with the laws of Queensland, Australia. Any legal proceedings shall be brought in a court of competent jurisdiction in Queensland.

10: Amendments & Validity

10.1 This Agreement constitutes the entire agreement between the Artist and BNBP and supersedes all prior agreements or understandings.

10.2 Any amendments or additions to this Agreement must be in writing and signed by both parties.

10.3 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

11: Agreement Confirmation

11.1 By engaging BNBP’s services, the Artist acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
